What does “bail” mean?
Bail is a written permission issued by the Court that allows a person charged with a crime to remain out of jail while awaiting trial or some other result of their case (ex. withdrawal of charges or a guilty plea).
If I get arrested, what should I do?
As per the Canadian Charter of Rights and Freedoms, you have certain rights, including the right to remain silent (except when giving your name, birth date, and residential address to the police), the right to have consult a lawyer of your choice or obtain legal advice from duty counsel- a free lawyer provided to you by the government. It is essential to know these rights when the police arrest you, and you must contact a lawyer right away.
The police just released me after filing charges. Where and when is my first court date?
Take a look at your Release Documents which is usually labelled “Promise to Appear” plus an “Undertaking,” and the details will be there. If you were involved in a less severe case, then the document might be labelled “Appearance Notice.” There will be two dates listed: your first Court appearance and the date you will provide fingerprints to the police. Failure to attend either or both can result in additional charges.
I think I am under investigation for a crime, but nobody has charged me yet. What’s my next move?
The Canadian Charter of Rights and Freedoms protects you in this circumstance. If the police schedule to meet with you and it feels they are investigating you for a crime, call a lawyer right away. If you have already met up with the police and find yourself detained or arrested, declare that you want to speak to a lawyer immediately. We can still help you even if you have already talked to the police.
